The place of economic and social rights in the European Union

Summary/Abstract: The Charter of Fundamental Rights of the European Union is deemed as a revolutionary document as it contains a comprehensive catalogue of fundamental rights, including, inter alia, civil, political, economic and social rights. It was argued that the initial idea behind the Charter was to provide equal protection to given categories. However, it introduces the unclear and inconsistent distinction between principles and rights. This article examines whether the given distinction constitute an adequate legal basis for marginalizing economic and social rights. Subsequently to giving a critical analysis of this confusing distinction, paper identifies other Charter’s formulations, which might be relevant in determining the place of economic and social rights in the EU legal order.
