Summary/Abstract: The European Court of Human Rights (ECHR) is an institution which is very significant not only for individuals but for states as well. By a careful analysis of the cases before ECHR the state can discover the problems in its own legal system and in this way try to resolve them more efficiently. In the paper, the author will analyse the problem related to the case length and the way pre-trial confinement is determined in Serbia. Both of these subjects will be analysed in the way ECHR treats them, this including requests that are submitted against our state having a direct insight into the problems in Serbia.
