Summary/Abstract: The paper examines to what extent has been built the supranational normative framework that regulate consular protection of the EU citizens in third countries, and discusses legal controversies as well as the institutional and political obstacles to a coherent and efficient enforcement of the right to consular protection. Since the adoption of the Treaty on European Union, the Member States have been working on a common framework for consular protection of the EU citizens in third countries where some EU countries have no consulates, in order to respond to the need for an effective consular assistance. Since the EU as an international organisation cannot be a party to the Vienna Convention on Consular Relations, the authors discuss whether the EU delegations should be responsible for consular assistance to EU citizens abroad. The authors conclude that the development of consular protection and assistance at the EU level will remain substantially challenged by the exclusive national jurisdiction in this policy area and the multiple interpretations of the idea of the EU citizenship.
