Summary/Abstract: Federalism, is the balance of power between the federation and its component entities. On one part, federalism operates in areas of law that indisputably fall within the competence of the EU. In addition to drawing the borderline between EU and national competence, federalism defines the relationship between the two levels of governance when they occupy the same policy field. On the other part, federalism also takes place beyond the bounds laid down by article 5 TEU (Treaty on European Union”after Lisbon, before Lisbon article 5 EC - Treaty Establishing the European Community).
