CONSIDERATIONSON THE ENFORCEMENT OF LAWNR. 302/2004 ON THE JUDICIAL COOPERATION, REPUBLISHED, WITH ITS SUBSEQUENTAMENDMENTS, FOLLOWING THE WITHDRAWAL OF THE UNITED KINGDOM FROM THE EUROPEAN UNION

Summary/Abstract: Law Nr. 302/2004, republished with subsequent amendments and additions, regulates the main instruments in the field of international cooperation. With the entry into force, on 1 January 2021,of the Agreement regarding the withdrawal of the United Kingdom of Great Britain and Northern Ireland from the European Union and the European Atomic Energy Community, some international cooperation instruments provided for by national law ,lose their effectiveness. Having regard to the provisions of Article 216 para. (2) of the Treaty on the Functioning of the European Union, consolidated version, according to which” the agreements concluded by the Union are binding on the institutions of the Union and on the Member States”, an analysis on the institutions provided for in Law Nr. 302/2004, republished, with subsequentamendments, by reference to the provisions contained in the Agreement.
