Summary/Abstract: With this study the author intends to present and analyze a case where the courts of law in applying the principle in dubio pro reo ordered the acquittal of the defendant. I consider the case is important taking into consideration the de facto situation, the different opinions expressed by the Public Ministry and the courts of law regarding the existence of the crimes and the quilt of the defendant. Also I shall present the practice of the High Court of Cassation and Justice regarding the presumption of innocence, fundamental procedural law in Romanian Law.
