Summary/Abstract: Initially, criminal sanctions alternative to the prison sentence have evolved differently in Romanian territories, due to different influences that have put their mark on the criminal justice system in the Romanian provinces. Subsequently, since the first half of the 20th century, we have witnessed a number of coordinated policies to implement measures that complement the legislative framework and allow different solutions for those found guilty of committing acts that form the content of crimes. During the communist regime, we find several alternative measures for prison terms, and some of them are only included in the Penal Code, without knowing any actual practical applicability. With the entry into force of the current penal code and the criminal procedure, we are witnessing an innovation in this area, with the legislator trying to include new legal institutions to enable the judicial bodies to provide a response as close as possible to the danger of the crime and the perpetrator.
