THE CRIMINAL LAW (MATERIAL) AND THE ASPECT OF CRIMINAL CORRUPTION OFFENSES

Summary/Abstract: The author emphasized the criminal (material) determinants of corruption offenses respecting the substantive provisions that deal with the alleged crimes. Emphasized the continuing need research on corruption as a complex social negative phenomena which successively destroys society and the state, and in this context, the determination and unity of the will of all the stakeholders can provide a direct or indirect contribution to on prevention of negative social phenomena. In this regard, special attention is paid to the efficient functioning of law enforcement agencies, whose statutory authority directly focused on the research, detection and prosecution of corruption offenses in the context of the Criminal Code and the Criminal Procedure Code Bosnia and Herzegovina. Starting from the procedural provisions of the Code of Criminal Procedure, determined and identified Procedural issues concerning the burden of proving these offenses, leading to the criminal procedure specifics of these crimes.
