LIABILITY OF LEGAL PERSONS FOR OFFENCES UNDER THE CRIMINAL CODE OF BOSNIA AND HERZEGOVINA

Summary/Abstract: The liability of legal persons for criminal offenses, handles the entire state legislation and the theoretical treatment of the institute corporate liability for crimes in Bosnia and Herzegovina. Given that the institute that deals with new due to the time of introduction into our law is treated comprehensively in conjunction with other institutes and in terms of tackles. Processed the first occurrence of the criminal convictions of legal persons that are mentioned in the paper. It is especially shown in place of corporate crime and corporate liability in relation to other types of crime and accountability. Processed the scene of a crime as a human act that causes damage to another, and at the same time discussed the possibility of the need to change the definition of the concept of crime with respect to the institute of liability of legal persons for criminal offenses in the criminal legislation of Bosnia and Herzegovina. Was carried out to compare the basis of responsibility for the crimes of legal and natural persons, although the same can not be compared, but at the same time important in terms of grading the criminal liability of legal persons, which allows individualization of punishment when the conduct of criminal proceedings and the determination of the same legal person. We also developed the basics and limits of liability of legal persons for the offense, it is important to reach this position of responsibility and accountability in the status of legal persons and legal persons responsible for the attempt, and the continued criminal offense.
