Summary/Abstract: Contemporary society faces a risk paradigm, with an obsession of social actors for precautionary conduct, which eliminates or at least minimizes the risks of dangerous activities, increasingly common in a modern society. The obsession with safety and concern for risk reduction is also reflected in the law in general and criminal law in particular. Although not enshrined in criminal law, being traditionally present in civil and environmental law, risk becomes an important element of analysis in the psychic position of the agent in relation to the conduct described in the criminalization rule, shifting discussions from the following result to the conduct itself. In the present study we have tried an analysis of the concept of risk by proposing a classification of risks in criminal law and establishing its criminal valences.
