Summary/Abstract: The article deals with comparison of objectivity of criminal judge courts and juries courts based on the novel Red Pullover written by French writer and lawyer Gilles Perrault. He described in details the criminal procedure with Christian Ranucci – one of the last death penalty sentenced person in France. He was executed altought there wasn’t guilty proved beyond the reasonable doubt. This misscarriage of justice took place because of susceptiveness of jury by public meaning and another circumstances. The article deals also with the situations in Czech criminal judiciary and problems with lay judges. Concretely with comparison these lay judges with jury, positives and negatives of both and possibilities which can be used by Czech judiciary reform which seems to be unavoidable.
