Summary/Abstract: The author was inspired by Théodore Géricault’s painting “Th e Raft of Medusa”, which, unlike other descriptions of the tragic situation of the shipwrecked sailors, leaves the moral and legal assessment of the acts of the survivors to the observer. Thereby it enables the reflection of further consequences of the competing doctrines of deontology and utilitarianism than is usual in the legal theory and literature. Consequently, the focus of the presented paper does not consist of the analysis from the point of view of criminal law, but rather in the reflection on the link between these ethical normative theories and the law-making, interpretation and application of law that indicates certain connections, not only between law and morals, but also between law and politics.
