Summary/Abstract: The article deals with selected issues in the formation of the contract. It will be demonstrated on the famous Czech comedy „Vrchni, prchni“ (1980). Defines current legislation in Civil Code and Commercial Code, refers to problematical aspects and evaluates the legislation de lega ferenda.
