Summary/Abstract: The article is a socio-legal study to the problem of the legacies of the communist past and their impact on the quality of democracy and social justice in the post-communist state. The author applies issue usually discussed in the transitional justice to the specific problem of dealing with the past in post-communist context of transformed police-state. He especially discussed relation between old and new regimes, decommunisationa and lustration, access to the secret police files and restitution of property as crucial elements of transitional justice in post-communist transformation. The last section sketches only the issue of impact of unsolved problem with the past on the quality of democracy and social justice.
