The historical evolution of the incrimination of the crime of infanticide

Summary/Abstract: The criminal law provides in the General Part generic notions of the facts dangerous for the society, and in the Special Part and in special laws it regulates each deed that constitutes a crime. In the present material, we have analyzed one of the crimes against life, namely, the murder or injury of the newborn committed by the mother. This deed falls into the category of crimes committed against a family member. We chose to present this topic, because from our point of view the deed itself is a contradiction between the natural love of the mother and the content of this crime. The connection between mother and fetus is indestructible, but we will see during the analysis that will follow that this connection can be destroyed due to a disorder and more. Society cannot perceive how a mother can commit such an act. If in the medieval period this aspect could not be explained, with the evolution of man over time, various researches have been conducted to understand what is the phenomenon that determines the commission of infanticide. The human being functions in normal parameters due to the psyche, but when it is affected by various events, feelings or changes in the body, disorders or certain diseases appear. These disorders, both emotionally and cognitively, produce an uncertain state inside the mother, uncontrolled until the moment of birth and causes her to feel overwhelmed.
