Summary/Abstract: The digitalisation of the judiciary is already a certainty, but it can also have negative consequences, such as limiting access to justice, if all the elements of this fundamental right are not taken into account when implementing the digitization process. In order to avoid limiting access to justice, a transitional phase should be implemented, in pursuance of preparing litigants, and, in addition, the existence of legislative omissions regarding the new challenges determined by the digitization process should be avoided. On the other hand, the advantages of digitization can be enhanced, provided that litigants are encouraged to use new electronic and telecommunications means in court proceedings and if all the current benefits of the digitization of the judiciary are acknowledged to their true value.
