Characteristic of the Evidence Proceedings in Administrative Procedures in Cases Regulated in the Construction Law Act

Summary/Abstract: The article concerns problems connected with the specificity of the evidence proceedings in administrative procedures in building cases, i.e. those regulated in the Construction Law Act. Peculiar feature of the evidence proceedings in such cases is connected with the kind of administrative procedures, in doctrine called “special procedure”. To conduct administrative procedure in such cases authorities use Code of Administrative Procedure and procedural regulations located in material act of law like the Construction Law Act. The characteristic features are: course of evidence proceeding, collecting of evidence before initiation of procedure, kind of partial privatisation of evidence proceeding, kind of evidential time-limit, material-law limits of the rule of open evidential system.
