Summary/Abstract: The long tradition of territorial military is reflected in the variety of arguments that justify it. Their multi-aspect nature does not raise any doubts. On the other hand, it is debatable to assess the practical implementation of the idea of ​​the Territorial Defense Forces, especially in terms of the possibility of holding a TDF soldier to legal liability appropriate to the army (criminal or disciplinary). Due to the framework of this study (after indicating: a historical outline, selected reasons justifying the return to the tradition of local troops or determining the legal status of a TDF soldier), the issue of legal liability of an TDF soldier serving: rotational or on-site, was discussed on the example of his disposal (in arbitrary manner) with military property in the form of a uniform. The entire study was completed with conclusions and de lege ferenda proposals, the implementation of which is necessary to ensure uniform standards of the soldier's legal liability.
