Summary/Abstract: The article addresses the issue of filing an election protest against the election of the President of the Republic of Poland, the purpose of which is to verify the overlap of voters' will on the election result. Only as a result of conducting the proper election process, the authority receives the right to exercise the powers assigned to it. Due to the undoubtedly similar systemic status between the Republic of Poland, the Czech Republic and the Slovak Republic, and the relatively small number of intellectual studies on this subject, it was decided to solve the following research problem: is the institution of electoral protest in the Republic of Poland dys-functional? Based on the collected materials, it appears that an election complaint against the election of the President of the Republic of Poland will not guarantee the effectiveness of election control, as long as it is not verified by an independent court.
