OVERVIEW OF CONTRACTUAL OBLIGATIONS OF THE KNOW-HOW LICENSOR UNDER THE MACEDONIAN LAW OF OBLIGATIONS

Summary/Abstract: The aim of this paper is to provide a comprehensive analysis of a part of contractual obligations of the licensor of know-how and their regulation in the Macedonian legislation. Special emphasis will be placed on two obligations that contracting parties inevitably incorporate into their agreement: the licensor’s obligation to transfer the know-how and to give the necessary instructions and information for its successful utilization, and the licensor’s obligation to guarantee the material and legal properties of know-how. Thus, this paper is divided into two systematic sections, focusing on each of these obligations respectively and examining the solutions contained in the Macedonian Obligation Relations Act that are applicable in the regulation of these contractual obligations.
