The International Criminal Court and Bulgarian Legislation

Summary/Abstract: This is the third article concerning the establishment of the International Criminal Court. The Rome Statute of the International Criminal Court is now close to its coming into force. This is why the resolution of the problems concerning the process of ratification in different countries and especially the need for implementing legislation are so important. The article aims at providing an overview of the issues of concern common to most countries. The idea is to see how the problem of surrender of nationals, the immunities of heads of states as well as substantial legislation are overcome in countries with different legal systems. The author provides an analysis of the ratification status of Bulgaria and suggests some solutions and interpretation of the issues, considered to be impediments to the ratification of the Rome Statute. Bulgaria is close to ratification, the ratification law is now pending in Parliament and it is very probable that our country will be among the 60 founders of the ICC, whose ratification will make possible the Rome Statute's entry into force.
