Contemporary Challenges for the Protection of Civilians During Defensive Operations – International Humanitarian Law Perspective
The paper addresses the issue of challenges to the protection of civilians in the contemporary armed conflict, and, in particular, in defensive operations. The challenges are identified in the text and analysed through the prism of how they affect the effectiveness and efficiency of IHL, its legitimacy, contents, individual provisions, scope, applicability as well as enforcement, at various stages of both the armed conflicts and the IHL itself. Special attention is given to the new challenges, originating from the newly changed security environment and nature of an armed conflict, the landscape of conflict parties as well as the strategies they use.
