L'enfant - victimes des sevices soufre des différentes conséquences. Chacune des formes du mauvais traitement produit certaines conséquences pour l'enfant. Sans égard à la forme de la violence qu'il subit, les conséquences les plus graves se manifestent dans le développement psychiquee de l'enfant. L'abus sexuel à la première vue ne laisse pas de traces visibles, mais il se reconnaît dans "les yeux vides de l'enfant". Le service de l'aide social offre de l'aide aux victimes à plusieurs niveaux: le contact directe avec le faiteur, l'intervention dans la situation de la crise, l'aide dans le but d'éliminer les conséquences qui durent ainsu que les mesures générales de prévention dont on empeche la soufrence renouvelée ou dont on adoucit les conséquences durables.

Within the European Union, a very large percentage of public investment is spent through public procurement. This trend has a significant impact on the financial costs of the Union, which is why a number of measures have been taken to create an adequate and flexible legal framework to ensure the delivery of better and more efficient public procurement. Some of these measures are aimed at adopting appropriate acts in the field, such as: Directive 2007/66 / EC of the European Parliament and of the Council, Directives 89/665 / EEC and 92/13 / EEC, the Single Market Strategy (COM (2015)) 550), as well as the European Commission‘s 2017 Public Procurement Strategy. The latter document is important for improving European practices in the field, as it defines priorities in Community policy with regard to public procurement. The Bulgarian legislator should be well acquainted with the European legal framework for public procurement with a view to its proper application in national law.

The article discusses the problematic issues of calculating the term for placing a person in a medical institution for the purpose of conducting the inpatient forensic psychiatric assessment (hereinafter referred to as the FPA) in criminal proceedings.Based on the materials of judicial practice: 1) a wide variability of the approaches of judges is demonstrated in the determination of the term for carrying out the FPA in the resolutions (since the legislator, in part 2 of Article 509 of the Criminal Procedure Code of Ukraine (hereinafter – the CPC), indicates only the upper limit of the time period for carrying out the FPA – up to two months); 2) the decisions of judges on the prolongation of the FPA are highlighted and analyzed. The necessity of legislative regulation of prolongation of the FPA term at the level of criminal procedural legislation of Ukraine is proved.In a comparative aspect, the normative regulation of the FPA term and the procedural mechanism of its prolongation in the criminal procedural legislation of the neighboring countries – Kazakhstan, Moldova, Uzbekistan, Estonia, etc. are illustrated. At the same time, the positive experience of foreign countries was recognized as suitable for adoption in the following aspects: (a) determination of the term of the FPA in days; (b) prolongation of the FPA at the reasoned request of the expert (commission of experts); (c) prolongation of the FPA for up to 30 days. In this case, the general term of a person’s stay during one FPA cannot exceed 90 days. However, if an additional or repeated FPA is required, its term must be recalculated. Attention is focused on the fact that the results of the assessments carried out may be different, but the establishment of a reliable mental state of a person acquires particular importance when deciding whether a person is subject to criminal liability. Therefore, it is emphasized that it is inexpedient to propose legislative regulation of the term limit for conducting the FPA in relation to a specific person in one criminal proceeding. It is concluded that since the issue of sending a person to a medical institution for a psychiatric assessment is resolved in the manner prescribed for submission and consideration of applications for precautionary measures (Part 2 of Article 509 of the CPC), it is logical that the prolongation of the inpatient FPA may occur in the order of extension of detention (Article 199 of the CPC).

Appeal proceedings has a specific structure that differs from that of the first instance. It consists of two stages – preparatory actions for examination of the case at a court hearing and court hearing of the appellate jurisdiction. Like the first instance, the preparatory actions for examination of the case at a court hearing, is a separate stage and possesses features that distinguish it from the same actions in the first instance. The mere court hearing of the appellate jurisdiction has six stages – the new stage, compared to the first instance, is a report by the judge-rapporteur, who is following the sub-stage actions to allow the case to progress at court hearing, and before sub-stage judicial trial.

СТРУКТУРА ПРАВНЕ НОРМЕ ПО ХАНСУ КЕЛЗЕНУ: ЈЕДАН „ДРУГАЧИЈИ“ ПОГЛЕД

La compréhention de la structure de la norme juridique de Kelzen est diamétralement con¬traire à la théorie traditionelle. Le détour fait par Kelzen ne se rapporte pas aux seuls éléments de la norme juridique mais à leur rapport mituel aussi. Selon l'auteur, pour la différence de la compréhention ancienne, c'est la sanction qui est primaire et la disposition secondaire. Même, la sanction "avale" la disposition, qui est tout à fait innécessaire en présence de la formulation claire du droit. Par rapport au traditionel, le déplacement de Kelzen au dedans de la structure de la norme juridique présente la "marche de l'éecrevisse". Kelzen va "à rebours", de la sanction, via le délit, à l'obligation juridique et droit subjectif, comme contenu de ce qu'on appelle habituellement disposition, ce qui est chez Kelzen une norme juridique secondaire, "non vraie". La vue "autrement" de Kelzen sur la structure de la norme juridique est la conséquence de son attitude théorique-méthodologique général. Par l'emploi de la méthode dogmatique normativiste Kelzen "épure" le droit de tout ce qui est normatif. Le droit est un système de normes, et ceci de ceux normes qui règlent le comportement des hommes par la préscription des actes de répression comme sanction. Par cette détermination Kelzen fait une certaine "épuration" aussi dans le domaine de la normativisation, en rejettant de son de¬dans la disposition comme un "déblais". A la notion du droit de Kelzen, basée en général sur l'analyse structuralle de la norme juridique, on essaye dans le dernier temps de donner l'importance d'une notion matérielle. Cet essai provient de Norbert Bobi qui considère que l'oppression, exprimée par la sanction comme élément normatif, présente un critère matériel valide pour la définition du droit.

The main objective of the present paper is to analyse whether the EU’s banking system is progressing towards conclusion of the present legislative reforms which were mainly triggered by the recent economic and financial crisis or, on contrary, it is still left at crossroads and the directions towards which it could continue forward are different. In the second part of the research the author presents other legislative initiatives in the banking sector initiated by the EU and some of which had already been published and implemented. Then the author focuses attention on the proposal for regulation pertaining to the structural measures to enhance the bank stability in the EU and discusses to what extent the latter could be treated as a concluding element for the banking reform in the EU.

This study first determined the terms "left" and "right" as a political phenomenon. Then, touching student’s and black’s movements in United States of America, it presents the basic characteristics and development of student’s movements in Germany and France in late 1960’s. The largest part of the study is dedicated to the student’s revolutionary movement in University of Belgrade in 1968, in which author of the study directly participated. In a completely new way it interpret the activities of Yugoslav President Tito and a group of professors and assistants of the Faculty of Philosophy in Belgrade gathered around the journal “Praxis” (“praksisovci”) in the movement. The study is also a contribution to a theory of revolution.

Овие првични наоди покажуваат дека, кога се работи за Национални институции за Човекови права, не е потребен униформен пристап за една институција да биде во согласност со меѓународните стандарди, се додека минималните стандарди се запазени. Почетните наоди исто така покажуваат и дека постои шема на повторување во однос на карактеристиките на овие институции, а во зависност од тоа дали се основани како индивидуални или колективни тела.
