L'interprétation constitutionnelle judiciaire des droits fondamentaux comme l'interprétation judiciaire autoritaire des normes constitutionnelles en totalité est qualifiée de constater explicitement la signification normative des norme consti-tutionnelles par lesquelles on touche directement ou indirectement la position subjective judiciaire. Les différences parmi les tribunaux constitutionnels européens dans l'in- terprétations des droits fondamentaux ne sont pas seulement de la nature termi¬nologique. A l'égard de l'effet juridique des droits fondamentaux tous les tribu¬naux constitutionnels européens se trouvent à la même position: par les droits fondamentaux on reconnaît le caractère du droit constitutionnel directement ap-plicable. Daprès leur valeur juridique ces droits se trouvent au dessus des droits communs constitutionnels ou lègals des citoyens. Pourtant à l'égard du cercle des droits auxquels on donne le rang des droits fondamentaux des différences entre les tribunaux constitutionnnels européens sont beaucoup plus frappantes. Au fond elles sont conditionnées par la seule standardisation constitutionnelles des droits des citoyens. Tandis que les constitutions de l'Autriche et d'Allemagne prévoient seulement le bouquet libéral des droits fondamentaux tant que les constitutions de l'Espagne et de l'Italie garantissent aussi quelques droits socio- -économiques fondamentaux. C'est pourquoi les nouvelles figures interprétatives dans l'autorité judiciaire constitutionnelle de l'Allemagne et de l'Autriche n'ont qu'élargi la portée normative des droits fondamentaux classiques. Elles ne sont arrivées jusqu'à la formation des droits fondamentaux modernes À cet égard la juridiction de ces tribunaux constitutionnels et les attitudes dominantes de la dogmatique judiciaire sont au fond identiques.

La pensée juridique actuelle est caractérisée par le procès de l'intégration de ces parties de différentes théories juridiques, qui ont survécu la critique et la réalisation des conceptions universellement admissibles« et des conceptions stables en rapport avec presque toutes les questions et problèmes. A ce propos, on quitte la position essentielle présente et on accède à la manière conventione- 11e de définir les catégories juridiques. Dans l'explication du problème de la va¬lidité des normes juridiques apparaissent de nombreuses théories »complexes« de la validité qui désirent dépasser l'unilatéralité des conceptions antérieures. Dans ce sens l'auteur a présenté les conceptions de base de quelques écrivains juridiques contemporrains qui insistent de synthétiser les connaissances et les résultats des conceptions antérieures de la validité comme la théorie behayiouri- stiaue — psychologique, ainsi que la complexe théorie réaliste de la validité de A. Ross, puis la conception normativo-réaliste de la H. L. A. Harte et la théorie analitico-linguistique de A. Peczenik. De nos écrivains juridiques on a présentait la théorie »intégrale« de la validité de N. Viskovic. Dans le traitement de cette question si complexe il faut commencer par l'essence du droit et ses normes dialectiquement compris, car ce n'est que l'ac¬cès dialectique qui dépasse chaque synthètisme et intégralisme et c'est lui-même qui rélie l'essentialisme et le conventionnalisme et qui peut présenter un pas en avant dans la pensée juridique moderne.

Marceli Chlamtacz was one of the representatives of the Lviv school of Roman law. One subject of his interests was the issue of fruits. He devoted an extensive monograph to the acquisition of fruits by a holder in good faith, entitled „O nabyciu owoców przez posiadacza w dobrej wierze w klasycznem prawie rzymskiem z uwzględnieniem prawa cywilnego austriackiego i niemieckiego” [„On the Acquisition of Fruits by a Holder in Good Faith in Classical Roman Law, with a Consideration of Austrian and German Civil Law”], where he attempted to demonstrate the interpolation of the rule of bonae fidei possessor fructus <consumptos> suos facit. The aim of this article is to present the Lviv scholar’s views regarding this issue. The author also includes the polemics of other Romanists with Marceli Chlamtacz’s views.

The subject of the following article is the views of German jurist Bernhard Windscheid on law and its interpretation. Bernhard Windscheid is traditionally regarded as a prominent representative of pandectists, conceptual jurisprudence, and legal positivism. In legal historiography an opinion about an excessive formalism and detachment from reality in his studies was held for a long time and is still partially maintained. In most recent studies, however, that assessment has been revised, and a more diversified picture of Windscheid has emerged of a scholar who is hard to define by means of simple formulas. The analysis of his views on law and its interpretation conducted in this article leads to the conclusion that the traditional picture of Windscheid as a representative of „bloodless conceptual jurisprudence” is incorrect. According to Windscheid, the aim of the interpretation of law is to find out the legislator’s intention and realize it accordingly, which however, does not exclude taking into consideration under some circumstances the requirements of legal relations and transactions with values such as righteousness. In Windscheid’s concept, limits of the interpretation of law are drawn quite broadly, although he simultaneously attempts to specify them clearly enough to prevent freedom of interpretation and not to jeopardize the certainty of law.

The subject of this article is an analysis of Szymon Rundstein’s theory of a legal norm. In the first part of his study, the author discusses primary trends in the theory of law in inter-war Poland. Indicating that normative concepts had few supporters, the author simultaneously notes that they attracted law practitioners dealing with legal theory. The second part is an attempt at reconstructing Szymon Rundstein’s views on legal theory. Having proposed his methodology, the author analyzes Szymon Rundstein’s statements regarding both a legal norm, a central category in his considerations, and a normative system. In conclusion, it has been pointed out that although Szymon Rundstein takes a very rigorous approach to the normative assumption about the “purity” of the theory of law, he appears to be fascinated with phenomenology and frequently alludes to psychological theories. Specifically, many references alluding to Leon Petrażycki’s tradition can be traced in his writings. Thus, Szymon Rundstein’s theory of a legal norm modifies the normative assumptions of Hans Kelsen and is an original concept that was developed under the influence of many theoretical-legal views. It undoubtedly has a lot to offer and requires “re-reading”.

Dans ce bref travail sont traitées trois questions fondamentales de la pro¬blématique de la motivation, à savior: la notion du motif, les espèces des motifs et leur influence sur la formation de la désicion et la manière d'agir dans le but de son exécution.Le mfotif est une tendence consciente à la réalisation d'un but déterminé, la tendance qui met en mouvement et incite l'homme à l'action en déterminant en même temps le cours même de l'activité. En tant que catégorie subjective elle a sa sourse dans le besoin comme catégorie objective. Il est le reflet de cette catégorie dans la conscience. Étant donné que les motifs surgissent des besoins, et que ceux-ci sont nombreux et se trouvent en transformation constante, les motifs, eux aussi, sont nombreux et tandis que les uns prennent naissance, d'autres disparaissent. En outre des besoins comme sources de l'activité con¬sciente existent aussi les instincts sur lesquels reposent les actions inconscientes, automatisés qui représentent l'activité héritée stéréotypée. Le comportement instinctif est chez l'homme exceptionnel et se manifeste en l'absance du con¬trôle conscient.Dans le cadre de l'exposition concernant les diverses espèces des motifs, une attention particulière est consacrée aux motifs organiques, de situation, déduits acquis.Le rôle le plus important des motifs est — leur influence sur la formation de la décision et la conduite des procédés dans le but de sa réalisation. La for¬mation de la décision est le premier stade dans la pratique d'une activité con¬sciente et volontaire. A savoir, l'homme, avant d'entreprendre l'action à laquelle il est incité par le motif, doit prendre une décision concernant son exécution. La décision représente en réalité une évaluation de la possibilité et de l'impossi¬bilité, de l'utilité et de la nocivité de l'accomplissement des activités qui consti¬tuent l'action et de l'effet atteint par sa réalisation. Dans le cours de la forma¬tion de la décision il peut se produire un conflit et une lutte des motifs. Dans cette lutte l'emportera le motif qui au moment donné vient à s'avérer le plus fort ou qui paraît le plus utill. Si deux motifs de force égale viennent en conflit, il se produira une vacillation et l'indécision. S'il n'existe pas des alternatives, il n'y a non plus la lutte des motifs, comme il n'y en a pas si l'un des motifs est accompagné des fortes émotions. Dans les cas pareils la décision est prise d'une manière simple et relativement vite et la volonté est inébranlable dans son exécution. Le caractère des motifs et leur conformité avec les sentiments est d'une importance exceptionnelle pour la formation de la décision et sa mise en oeuvre dans la vie, et l'établissement des motifs pour l'évaluation de la qualité de la décision et le choix des mesures de correction éventuelles.

The article provides a comparative analysis of the specific purpose of the trial clause and the training clause as elements of the content of the employment contract for a trial period and the employment contract for learning at work. In practice, a number of labour law disputes arise over the effect of both types of employment contracts. The main reason for this tendency is the lack of sufficient knowledge of their character and designation. The analysis carried out reveals the main specifics regarding the purpose of the employment contracts under Art. 70 and Art. 230 of the Labour Code, which will facilitate their application in practice. For the purpose of completeness of the study, the current case-law relevant to the issues raised has also been considered.

In the first of Czechoslovak republic, mainly under the influence of the normative theory, started many legal researchers to pay attention to public law branches. Administrative law and self-government were not the exceptions. The discussion about self-government was focused mainly on the issue of its function in society. On the one hand, we are confronted with a political concept of self-government, and on the other hand, with a legal concept of self-government. The political concept of self-government was based on the historic originality of local authorities and on the idea that self-government is a collective version individual that has natural rights. The theory of legal concept of self-government was based on the fact that, despite the historic originality of the municipalities, the State is the only sovereign on its territory. The municipality is therefore only subject of its power and its competence is being delegated by the state. Self-government is therefore a collective organization created by state.

In every state that has decided to introduce to its legal system the oversight of public administration by an administrative judiciary, one of the most crucial points appears to be the question of regulating the scope of such control. The creation of administrative courts itself does not guarantee proper and full protection of citizens against the actions of the authority. As is shown by the history of statutes of control, the legislator can de facto freely influence the judges in this matter by introducing either the so-called enumeration clause or a general clause. Both aforementioned ways of determining the scope of contesting are derived from German legislation, in which Rudolf von Gneist’s and Otto Bähr’s concepts were „competing” over the years. The first saw the administrative judiciary mainly as an institution to protect the objective law order. For the latter, who put the individual’s rights first, it was pivotal that the administrative judiciary should provide full protection of citizens against the actions of the executive power. And it was the second of the two theories that led to a gradual disappearance of determining the object of protection in statutes regarding administrative court procedures by listing the categories of affairs liable to control (enumeration) with general clauses allowing submission of conceivably all activity of public administration to the cognizance of the courts. The profound influence of ideas proposed by German administrative law theorists on contemporary views of the administrative judiciary’s role in a democratic state following principles of the rule of law is clearly visible in an analysis of Polish regulations applying to administrative court proceedings. Earlier, in the 1980 Supreme Administrative Court Act, the legislator excluded the „inconvenient” administrative cases by enumerations; this limitation presently seems impossible. This article presents how the regulations regarding the scope of control of the administrative judiciary in Poland and Germany were changing over the years. The comparative method was mainly aimed at showing the changing approach to the judicial oversight of public administration. The ideas adopted from our western neighbors were influential in the theory of administrative law not only in Poland, but also in Europe.
