General characteristics of the appeal proceedings in the Criminal Procedure Code

Summary/Abstract: The principal rules of the appeal proceedings rules have been studied in the article and conclusions for its legal nature have been made. The author's viewpoint is that the appeal procedure laid down in the Criminal Procedure Code in Bulgaria is inconsistent with the classical meaning of the concept ,full appeal", but that used to be the case in the Criminal Procedure Law of 1897. The classical appeal procedure is also typical of some western legislative systems (France, Belgium). In the article have been examined the specific issues related to the admission, the inspection and the appraisal of the proving material from this instance. The recent practice of the Supreme Court of Cassation in relation with the application of the appeal proceeding rules has been also studied.
