Allocation of the Use of Common Property

Summary/Abstract: The article considers the specific issues of co-ownership and in particular the right of personal use of the common property which exists in favour of each co-owner. The restrictions of this right are thoroughly examined as well as the different ways to allocate the use of the common property: via a contract between the co-owners, via majority decision or via a court decision. Special attention is paid to the differences between the legal consequences of these three forms of allocation.
