Summary/Abstract: This article examines the possible effects of the withdrawal from the EU under Article 50 TEU. It is the first time that the right of a Member State to terminate its participation in the system of European integration has been enacted in the primary EU law. Therefore, the nature of the withdrawal, its procedure and effects need to be examined.Article 50 TEU does not provide for substantive conditions for withdrawal; it rather has a procedural nature. A withdrawal procedure is provided for, ending with an agreement between the Union and the withdrawing Member State. The agreement must define the conditions of withdrawal and the framework of future relations between the Union and the withdrawing Member State. The said agreement does not constitute an indispensable condition for withdrawal. The latter will take place within two years following the notification given by the withdrawing Member State.The main legal consequence of withdrawal is the termination of the effect of all EU law on the territory of the Member State that has withdrawn from the Union. Along with that, a number of other legal and factual consequences can also be observed as a result of the withdrawal. The State would lose the opportunity to enjoy the privileges of the EU regulatory apparatus and, particularly, those relating to the interpretation and development of EU law. The practice of the European Court of Justice would not be applicable to the State that has withdrawn from the Union. The procedure for preliminary rulings will not be available. The rights arising from EU citizenship will also be terminated. The rights acquired by virtue of a treaty will be invalidated. Institutional changes will be significant and budgetary implications are difficult to calculate.
