Summary/Abstract: The article discusses the question of the influence of the practice of the European Court of Human Rights on personal search legislation, according to the Bulgarian Code of Criminal Procedure. On the basis of research about ECHR decisions concerning personal search, are discovered the main standards related to the protection of human rights. A comparison analysis between national criminal procedure legislation and main ECHR standards regarding personal search is done and responding recommendations for possible changes in legislation are presented.
