Summary/Abstract: This article looks at the factual situation of the Rosneft case and the reference for a preliminary ruling, the jurisdiction of the Court of Justice of the European Union in the sphere of the Common Foreign and Security Policy, the judicial review of lawfulness. What is presented is the status, respectively the development of the jurisprudence of the Court of Justice in matters relating to its own competences with regard to the CFSP within the context of fundamental rights issues following the entry into force of the Treaty of Lisbon.
