An Individual as a Subject of Legal Protection in the Context Of Selected Aspects of the Amendment of the Code of Administrative Procedure in 2017

Summary/Abstract: The Code of Administrative Procedure is the most important normative act in Polish administrative law, defining the procedural framework for the examination of and delivery ofrulings on the majority of individual administrative cases. The Code plays a crucial role in safe guarding the rights of the individual, having an impact on the legal situation of the addressee of an administrative decision. Much attention has already been given to the profound changes introduced into the Code in 2017; however, the findings of the analyses performed sofar have mostly been critical. This study aims to identify the positive aspects of the thorough amendment of the Code in 2017. They complete the picture and may be informative to a nolesser extent than critical remarks referring to the body of these changes as a whole.
