Summary/Abstract: This article aims to promote a new perception regarding the confluence between criminal law and crimes containing a provision that refers to the pregnant woman or the biological mother. We are trying to establish a starting point for future debates on ways and means of criminalizing offenses related to pregnancies and mothers, and on how criminal laws can have a significant impact on discriminatory or problematic situations that are not taken into account at first glance. The ultimate goal of this study is to make an introduction to the problems that a surrogate mother may face within a criminal court and to become a concept – example for later studies in this niche.
