Summary/Abstract: The responsibility of administration and the lawfulness of the administration must have been controlled by judicial institutions is one of the fundamental principles in the laws of the modern states. On the other hand, the responsibility of administration is not unlimited. Although the liability of administration has been arranged clearly in the Turkish Constitution of 1982, there remain some unclear points about the limits mentioned above. This paper deals with arguments, whether the Article 65 of the Constitution which arranges ‘the extend of social and economic duties of the state’, limits the responsibility of administration or not.
