Summary/Abstract: The paper describes a statutory model of trade unions at the employer level inPoland. Freedom of associacion guaranteed in ILO Convention No. 87 includesfreedom to establish union structures. However, the Polish legislator enforces Polishtrade unions to establish so-called ’works union organizations’ at the employer level.Trade unions which does not establish a ’works union organization’, exercisepractically no rights of workers’ represenation at the employer level. In effect Polishlaw is a significant obstacle to development of trade unions in contemporary Poland
