Principle of proportionality and criminalization. Remarks on theory and practice based on Contitutional Triubnal's judgment SK 55/13

Summary/Abstract: Article presents views on the role of principle of proportionality placed in article 31 par. 3 of Polsih Constitution in ideal type of the legislative process which inteds to criminalize types of acts and to describe how judical revew of contitutional legitimacy of criminalization look like. Article is based on analysis of case-law of Polsich Constitutional Tribunal, with particular emphasis on judgment from 4th of November 2014 sign. SK 55/13, which refers to valdity of marijuana criminalization. This approach is very useful and shows how deep relations between crimnal and constitutional law are.
