СПОРАЗУМ О ПРИЗНАЊУ КРИВИЦЕ У ТЕОРИЈИ, ЛЕГИСЛАТИВИ И ПРАКСИ
Plea Bargaining in Legal Theory, Legislaton and Legal Practice

Summary/Abstract: Plea bargaining was first introduced in the Serbian legislation in the Criminal Procedure Code of 2006. However, as this legislative act remained unapplied, the legal provisions on plea bargaining were incorporated into the existing 2001 Criminal Procedure Code during its updating in 2009. Given the fact that it has been more than 3 years since the beginning of the implementation of plea bargaining and bearing in mind that a new criminal procedure code is currently being developed, we consider that it is time to take a critical look at the experience in its application and to give some suggestions for its future regulation de lege ferenda.
