COLLECTIVE CLAIMS: ADVANTAGES AND DISADVANTAGES OF THE PROCEDURE

Summary/Abstract: The most important advantages and disadvantages of the collective claims from point of viewof both the victims and society have been identified in the article. The strong and the week points ofthe procedure have been brought out mostly on the basis of a comparative analysis with individualactions. The collective claim has considerable advantages mainly regarding injuries that have affectedmany victims whose damages have been low. Some of the disadvantages which are typicalfor the American procedure (class action) exist and others can possibly appear in countries in theEuropean Union too. For its part this determines the need to envisage appropriate safety mechanisms.
