Content Elements of the Code of Administrative Procedure

Summary/Abstract: This article continues the analysis performed in a previous study of the same revue concerning the actuality and the necessity of a Code of Administrative Procedure. The new article is about the elements which must be included in the future regulation regarding the procedure for drawing up individual administrative acts, the legal regime applicable to administrative contracts, the principal aspects concerning the administrative appeal to the issuing authority and to the superior hierarchical authority but also the administrative jurisdictional control. The analysis does not refer to all these institutions of administrative law, but only to the elements related to these institutions that should be regulated in the future Code of Administrative Procedure. These aspects as well as the others already mentioned in the previously published article, we believe that must be included in the new regulation more and more necessary both for the administrative practice and for the evolution of administrative jurisprudence in the administrative courts.
