Summary/Abstract: The present essay provides an answer to the alternative question of “regulations” or “commands”? with respect to the authority of the state administration. The problem to be solved is not a problem of an axiologically determined choice but a problem of a long- streched historical process beginning from the XVII-XVIII century which outcome resolves the instant alternative and thus marking the actual change of the manner in which authority applies its techniques of administrating. Both of the key categories of the title are examined as categories comprised by the more general and big framework of two contending paradigms, which characterize two contending ways of exercising authority in two different historical periods. The essay’s resolution discusses a problem which is essential in the light of the question provided by the title to be reflected on. It deals with the peculiar and essential stance of the administrative court system in the configuration of state institutions, which is exposed through a more general and at the same time providing a profound analysis point of view.
