Summary/Abstract: In this article the author investigates foreign experience in regulating the status of a suspect in a criminal trial, the procedural order pre-trial detention, the detention, custody. Considering this included and the suggestions made to the Criminal Procedural Code of Ukraine for further application in practice. The author proposed to learn from European countries, which suggests the advisability of including such provisions in the structure of Ukrainian legislation. However, some proposed innovations and their implementation mechanisms that actually "imported" from foreign experience, particularly Germany, are seen to be problematic in modern Ukrainian realities, including a shortage of public funds.
