Summary/Abstract: During the working hours, the employee is in a relationship of dependence, on his employer, which is likely to restrict his individual freedom. It is a restriction to which he consented, and without which the very execution of the employment contract would not have been possible, however, a restriction that may also affect the worker’s private life. And the question that arises in this context is: under which circumstances can we talk about the employee as a holder of the right to private life and how much of this is actually given to his employer during the working hours? The paper attempts to investigate the possible implications of the continuation of private life – spatially – at work and – temporally – during the work time, in order to identify the limits the employer is entitled to restrict. Although labor law and the human rights protection movement remain distinct, the employee does not give up his or her attributes of being a citizen when he reaches his workplace. On the contrary, he still has private life, he continues to exercise his constitutional freedoms and is the human rights holder, a platform that he will not descend by simply concluding a labor contract.
