Summary/Abstract: In this study I present the main issues related to the protection of the trademark, with the main fokus on the problems of the right of protection for a trademark and the claims resulting from its infringement. I consider the nature and content of the right of protection for a trademark in the Polish legislation. Further analysis was carried to stress out the violations of the right of protection with special emphasis entitled to the holder of this reason claims. The reflections have been supplemented with comparative law conclusions , relating to Polish law. Considerations were based primarily upon the regulation contained in the Act of Industrial Property Law of 30 June 2000. Due to the size and nature of the work, the principle of the provisions of the Law on Unfair Competition of 16 April 1993., which are the foundation of the so-called supplementary protection of trademarks are not included. In addition, attention was paid mainly to substantive issues, rather than not going into the subject of the law-processing.
