Summary/Abstract: Following the adoption of Part IV of the Commercial Code, entitled “Bankruptcy” there was a need to create a legal mechanism to compensate the debtor for damages in case of undue application for opening of insolvency proceedings. For this purpose is introduced art. 631a of the Commercial Code.
