Sources of Penal Law in the field of sport and harmonization of Serbian regulations with international legal standards

Summary/Abstract: Sources of Penal Law regulating counteraction of illegal behavior in the field of sport are numerous and various. At the international level, the most important sources are the following: the European Convention on Spectator Violence and Misbehavior at Sports Events and in Particular at Football Matches, the Council of Europe Antidoping Convention, International Convention against Doping in Sport, Olympic Movement Antidoping Code and World Antidoping Code. The content of previously listed conventions has been analyzed and clarified within this article. Analysis showed that all of the above listed conventions recognized the need for public authorities and independent sports organizations to work together in facing their separate yet complementary responsibilities to combat illegal conduct in the sphere of sports and sports related activities. Besides that, relevant Serbian regulations were analyzed and presented. Author explained that Serbian regulations pose a very wide scope of provisions aimed at curbing the occurrence of spectator violence at their sports stadiums and facilities. Also he explained national legal framework regulating fight against doping in Serbian sport. The conclusion was drawn that all of Serbian laws in that field were drafted and enacted to satisfy the exigencies of the Council of Europe Convention on Spectator Violence, Council of Europe Antidoping Convention and International Convention against Doping in Sport. The problem of inefficient application of Serbian laws and regulations was also mentioned within this text. Some proposals for solution of those problems were formulated and proposed.
