Summary/Abstract: The author is a member of the board of Polish Employers Association Ochrona and the author of pioneering studies designed to investigate the degree of participation of companies protecting people and property in ensuring public safety in Poland. In the course of the research conducted two years ago, he has determined that it is possible to raise the level of efficiency of the private security industry, which is an essential element of the public security system. The author mentions some of the most important results of his research, which clearly show that the security staff: – earn wages well below the minimum wage in Poland – spend too much time at work exceeding the standards set out in the Labour Code, – are generally employed on the basis of civil law contracts, the so-called “junk” contracts. The author points out that the provisions of the Act of 22 July 2016 amending the law on the minimum wage and other legislation are part of the realization of proposals he has formulated on the basis of the results of his research. Being satisfied with this fact, he decided to pose another research question – Has the introduced legislation aimed at improving social and living conditions of a security employee had the expected effect? To address this research question the author has used the analysis of service procurements in the security sector, the opinions formulated by local employers in the industry, trade unions, as well as the diagnosis of representatives of the state bodies responsible for the implementation of and compliance with new regulations. According to the author, the changes in legislation have had the desired effect, but there are also problems with dishonest employers and clients who do not respect these new solutions. Hence, it is necessary to monitor the current situation and carry out audits to eliminate all cases of underreporting the amounts of contracts and salaries. Such practices threaten not only the workers’ rights but also are a manifestation of unfair competition.
