Summary/Abstract: In the article the author discusses the current and proposed legislations on the use of social clauses in public procurements. There are presented the current provisions of the Act on Public Procurement, the new directives (2014) and the proposed provisions of the new Act on Public Procurement (2015 draft). The author focuses on the part of the act which concerns the application of social clauses. Although the very concept of social clauses is not defined by act, however the doctrine agrees that, in essence, there matters the provisions which create to a contracting party the possibility to impose on a contactor the employment obligations in executing the order from people belonging to a group of disadvantaged people. The article emphasizes a scale of public procurements in Poland and the areas of the clauses application to-date. The author proves that without changing the attitudes of the persons who have an influence on the contents of the public procurement notice, the amended regulations will not lead to the achievement of the objective which is a reduction of people affected by or threatened with poverty
