Summary/Abstract: Based on the analysis of judicial practice, declaration of a right (encumbrance) missing is compared with other ways of protection of rights in rem. It is shown that this declaration takes an independent place among the negatory ways of protection of rights to real estate and, accordingly, is included in the security element of modern Russian legal model of the real estate turnover system.
