Summary/Abstract: The 25-pages contribution deals with the damage to funds of Social Insurance Agency caused by pension benefit, which was paid unjustly or in a higher amount than due (caused by overpayment of pension benefit). The contribution examines the conditions of accountability for overpayment of benefit: benefit recipient´s accountability or employer´s accountability in the execution of social insurance, unwarranted enrichment of third parties in civil legal relationships, contractual responsibility of post office or bank and employee’s accountability.
