Legal reasons for modification of classification of juridic persons codified in Can. 99–100 CIC/1917

Summary/Abstract: The author of the presented article focused his attention on the question of legal reasons for modification of classification of juridic persons included in Can. 99–100 CIC/1917. He pointed out that what influenced the most the current form of Can. 115 §§ 1–3 CIC was the desire to adjust the classification to institutional solutions existing in the canonical legal order. The author believes that despite the immense effort of the codifying body, the typology included in Can. 115 §§ 1–3 CIC does not befit the reality of the Church in its legal dimension. This is because in the canonical legal order apart from the categories of persons mentioned in Can. 115 §§ 1–3 CIC there are other types of persons of mixed nature that do not fit the classification codified in this regulation.
