The Legal Regulation of Probation - A Comparative Survey

Summary/Abstract: Today neither theory, nor practice deals with dispute on the juridical nature of probation. This kind of criminal category is declared a punishment, which is expressed in combined and restriction measures. Super¬vision over its realization is assigned to the specific institutional mechanism, which some countries call probation department. In other legal systems, it is the arrangements of the law, which indicate that this kind of criminal category is not conceived as punishment. In conclusion, various legal arrangements of probation are not reflected in its taking effect, or its' clarification. For this reason, this dispute is not a fundamental issue.
