Summary/Abstract: Insolvency is an integral element of business and economic relations. As a result of a declaration of bankruptcy, the creditors’ interest is secured against the bankrupt estate. Insolvency may result from unsettled liabilities or excessive liabilities. Both premises are independent from each other. This paper aims to present the premises of insolvency as well as to offer recommendations and suggestions related to bankruptcy declaration. It also discusses German insolvency regulations.
